BAC Resolution Declaring Negotiated Procurement as an Alternative Method
RESOLUTION NO. 8, S. 2012
WHEREAS, the Polytechnic University of the Philippines advertised for the second time the Invitation to Bid for the Supply of Janitorial Services in a newspaper of nationwide general circulation, in the PhilGEPS, and in PUP website continuously for 7 days, after the failure of bidding on May 18, 2012;
WHEREAS, in response to the said advertisements, only one (1) prospective bidder submitted a letter of intent;
WHEREAS, on the opening of bids held on June 19, 2012, CMPT Manpower Services was declared as NOT COMPLYING with the requirements of the first envelope for the bidding of Supply of Janitorial Services;
WHEREAS, on June 20, 2012, a Motion for Reconsideration (MR) was filed by the CMPT and received by the PUP Office of the Vice President for Administration on the same date;
WHEREAS, on June 27, 2012, the members of the Bids and Awards Committee RESOLVE to deny the Motion for Reconsideration;
WHEREAS, on July 04, 2012, the members of the Bids and Awards Committee recommended a second failure of bidding for the said project;
WHEREAS, the Bids and Awards Committee likewise recommends a 100% absorption of janitors for the negotiation of a contract for the supply of janitorial services; and
WHEREAS, the two (2) failed biddings give the procuring entity the right to directly negotiate a contract with technically, legally and financially capable supplier, through negotiated procurement pursuant to Sec. 53 of the Revised IRR of R.A. 9184.
NOW, THEREFORE, for and in consideration of the above premises, We, the Members of the Bids and Awards Committee, hereby RESOLVE as it is hereby RESOLVED to recommend Negotiated Procurement as an alternative method of procuring the said Supply of Janitorial Services, which conforms to the provisions of Sections 53.1.1 to 53.1.6 of the Implementing Rules and Regulations of R.A. 9184.
RESOLVED, at the Dr. Mateo Conference Room, 2nd floor, South Wing, PUP Mabini Campus, Sta. Mesa, Manila, this 27nd day of June, 2012.
