Acceptance of Terms
IMPORTANT-READ CAREFULLY:
The services that PUPWebSite provides to you are subject to the
following Terms of Use ("TOU"). PUPWebSite reserves the
right to update the TOU at any time without notice to you. The
most current version of the TOU can be reviewed by clicking on the
"Terms of Use" hypertext link located at the bottom of
our Web pages.
This TOU is a mutual agreement between you (either an
individual or a single entity browsing or interacting with
this Internet Site) and Polytechnic University of the Philippines
("PUP" or "University")
for its official Internet site with principal Internet address at http://www.pup.edu.ph,
which may include associated media, web services, other companies,
sub-websites, printed materials, and "online" or electronic
documentation, including PUPWebSite Connect ("PUPWebSite"). PUPWebSite is developed,
managed, and administered by the Information and Communications
Technology Center ("PUP ICT Center"). By visiting, browsing or
interacting with PUPWebSite, you agree to be bound by this TOU. If
you do not agree, do not visit, browse or interact with
PUPWebSite.
The information contained in PUPWebSite ("INFO") is provided by
PUP and may be used for informational purposes only. By
downloading any of the INFO contained in PUPWebSite, you agree to
the terms and provisions as outlined in this legal notice. If you
do not agree to them, do not use this site or download INFO.
PUPWebSite and all its components (that are located within PUPWebSite) are protected by copyright laws and international
copyright treaties, as well as other intellectual property rights
laws and treaties. PUPWebSite is accessed within conditional
usage, not on full-entry access. These include, but not
limited to, the following provisions:
GRANT OF CONDITIONAL USAGE. PUPWebSite is within
conditional usage as follows:
Visiting, Browsing, and Interaction. PUP grants you conditional access to visit, browse, and interact with PUPWebSite as long
as you abide with this TOU on your
computers running validly licensed copies of software for which PUPWebSite was designed.
Ownership of Data. The INFO in
PUPWebSite is owned by PUP and is managed by PUP ICT Center. This
INFO is protected by intellectual property
rights and may not be distributed,
modified, reproduced in whole or in part without prior written
permission from PUP and PUP ICT Center. The images from PUPWebSite may
not be reproduced in any form without the prior advance
written consent from PUP ICT Center (from which the
images were originally developed). The University and PUPWebSite's inscription and
PUPWebSite, consisting the logo and the typeface, should
follow the standard. It cannot be altered in any way, such as
in layout, shape, font, font style, font size, position or
color. When permission to reproduce materials are granted, the
University and PUPWebSite should be acknowledged as the source
of the materials. Other data used in PUPWebSite, which
is copyrighted by other entities are properly acknowledged within
the Web page.
Reference Copies. You may also make copies of CERTAIN
parts of PUPWebSite as may be necessary for educational,
reference, and archival purposes only. (Please read the "Ownership of Data" clause)
Links to Other Web sites. PUP makes no
representation whatsoever regarding the content of any other
Web sites, which you may access from PUPWebSite. When you
access a non-PUPWebSite, please understand that it is
independent from the University and that PUP has no control
over the content on that site and it does not mean that PUP
endorses or accepts any responsibility for the content or use
of such site. Other name entities of other organizations
used within PUPWebSite are also protected by copyright laws
and international treaties.
Feedback and Information. Any feedback you
provide to PUPWebSite shall be deemed to be non-confidential.
PUP, PUPWebSite, and PUP ICT Center shall be free to use such information on any unrestricted
basis. Advertisements sent thru PUP
e-mail addresses are strictly prohibited. If you have
proposals, make a formal letter of introduction first.
PUPWebSite Feedback. PUPWebSite Feedback uses e-mail
technology to send messages to PUP. You need to have an
active e-mail account to use this. Using this binds you to this provision:
You can send your queries, views, comments,
suggestions, greetings, and any messages - either
expressed or implied - provided that you hold responsibility and
will be liable for any content you send to your full knowledge and concern,
in the entirety of the content.
PUP, PUPWebSite, its
developers, and PUP ICT Center are not liable and responsible for
any obscene
and/or illegal/illogical terms/words/topics used or against
any/other individual or organization.
PUPWebSite Connect Services
PUPWebSite Connect is an integrated suite of Web-based
applications and online services that enables information,
systems, and people collaboration through seamless utilization of
Web Technologies.
By submitting your information, you indicate
that you agree to the TOU,
have read and
understand the PUPWebSite Privacy Statement,
and confirm that the information you will provide to PUPWebSite are true and
correct to the best of your knowledge.
Your submission
of this form will constitute your consent to the collection and use of
this information and the transfer of this information for processing and storage by PUPWebSite and Polytechnic University of
the Philippines.
Furthermore, you also
agree to receive required administrative and legal notices such as this
electronically when your information is in question.
PUPWebSite
Connect allows you to use your preferred username and password
during sign-up. Your username will uniquely identify you
from other users and is unchangeable throughout your use of
PUPWebSite Connect. Your password, as well as some fields in your
profile, can be edited at anytime in the MyProfile
component of PUPWebSite Connect, provided that the information
is true, correct, and does not violate any laws.
Terms of Service. By registering and using
PUPWebSite Connect Services, you agree to the following terms and
criteria, and abide by all of its rules and policies:
PUPWebSite Connect gives
members a place to meet, interact, and share ideas with each
other. Just like a real community, you may have different
opinions than others members.
The PUPWebSite Connect experience is best when members follow
a few rules. Here are some key ones to remember:
- You remain solely responsible for the content of your
messages, and you agree to indemnify and hold harmless this
forum, the University, and the developers with respect to any
claim based upon any post you may make. We also reserve the
right to reveal whatever information we know about you in the
event of a complaint or legal action arising from any message
posted by yourself.
- Although messages posted are not the responsibility of
PUPWebSite and PUP is not responsible for the content or
accuracy of any of these messages, PUPWebSite Connect
reserves the right to delete any message for any or no
reason whatsoever. If you do find that the post is
objectionable, please report it to the Connect
Administrator.
- Do not harass, abuse, or threaten other members. Incidents
of harassments towards other members are taken very seriously
and should be reported immediately to Connect Administrator.
Appropriate action will be taken at the discretion of the
Connect Administrator.
- Remember to respect the views of others. Some topics that
are posted might be controversial or offensive to the
sensibilities of some. If you feel strongly against such
topics, you can practice courteous responses or report the
concerned post to the Connect Administrator.

- Please refrain from cursing or insulting others.
Respecting others is tantamount to earning respect from
others.
- Keep your arguments clean, logical, and non-hateful. We don't want any
mudslinging and flaming going on in PUPWebSite Connect as it affects everyone.
- Try to stay on topic. If you want to discuss a topic that
is not related to the forum area in which you are
participating, try going to another topic area or create a new
one. Posts/Threads should be relevant to the category which it
is contained in. Posting off-topic will result in your
messages being moved, locked, or deleted.
- Do not post content that is obscene, vulgar, defamatory,
inaccurate, harassing, hateful, threatening, invading of
others privacy, sexually oriented, violating any law, or
otherwise objectionable.
- Refrain from using these services for profit, commercial
or advertising purposes. PUPWebSite Connect must not be used for political purposes.
- Do not post copyrighted content that is not owned by yourself nor content owned by PUP without permission from
the owner.
- Please avoid TYpInG LYk DiS and refrain frm usng 2 mch
encryptd txt shrtcts. That way, everyone will have an easier
time reading the posts.
- Please avoid using ALL CAPS or CAPITAL LETTERS
throughout the content of your messages. It gives
other users the wrong impression that you are shouting.
- Please avoid flooding posts as it will cause everyone to
suffer in terms of the site performance. Flooders who posts
nonsense messages could very well get their accounts banned.
Also, avoid using extensive uses of line spacing. We will
consider this as flooding.
- Please keep attached pictures small since posting
unnecessarily large pictures will ruin the layout of the site
and slow down the loading of pages for other posters. Be
considerate of other's bandwidth as most of us are still
connected via dial-up.
- Avoid posting contact numbers (mobile, landline, etc) of
any member, non-member, students, or professor here. Since
this is an open forum, doing so might leave the victim open to
harassment. Let us respect the privacy of others.
- Adult-oriented content is permitted in a limited
scope only and is controlled by the Connect Administrator. You
must be 18-years old or over to access these areas (for
example, adult chat and adult groups).
- The Children's Online Privacy Protection Act of 1998 (COPPA)
requires that Web Sites are to obtain parental consent before
collecting, using, or disclosing personal information from
children under thirteen (13). If you are below 13 then you can
NOT use PUPWebSite Connect. Do NOT register if you are below the age
of 13.
- PUPWebSite Connect reserves all rights not expressly
indicated in this terms of service.
PUPWebSite Connect edits any content in its site if it needs
editing without prior notice for any or no reason whatsoever. Postings that violate the terms
set by the site may be removed and lead to the deletion, without
prior notice, of your Connect Account and everything associated
with it, including username, posts, and profiles.
Please report any violations of the terms to the
Connect Administrator.
DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Pre-released Web sites. If any component of
PUPWebSite or any of its components are marked
"Pre-released", "Beta", "Currently
being updated", "To be
Updated..." or "Under Construction", that
component constitutes pre-release INFO and may be changed
substantially before its formal release. You have the option
not to visit the Web page in a live operating environment
where it may be relied upon to perform in the same manner as a
formally released component or with data that has not been
sufficiently backed up.
Maintenance of Copyright Notices. You must not remove
or alter any copyright notices on all copies or pages of
PUPWebSite.
Not for Political Use. PUPWebSite is not to be used in any form of politics or political agenda. PUPWebSite is academic and service-oriented by nature.
Distribution. You must not distribute copies of
PUPWebSite and its INFO to third parties.
Statistics.
PUPWebSite reserves the right to
collect the following information on the client's computer:
IP address, browser tag, browser type, browser version, browser language,
Mozilla version, operating system type, operating system subtype,
operating system version, and robot info. These data are
used for statistical purposes.
Prohibition on Hacking, Intrusion, Reverse Engineering, Decompilation, and
Disassembly. You must not hack, infiltrate, reverse engineer, decompile, or
disassemble PUPWebSite or any component within the PUPWebSite
network. Also, you must not use any special hardware or software
to download all the files from the PUPWebSite server (either with
or without any
intention to vandalize, hack, or destroy the PUPWebSite system).
Rental. You must not rent, lease, or lend PUPWebSite.
Transfer. You cannot transfer all of your
rights under this TOU.
Compliance with Applicable Laws. You must comply with
ALL applicable laws (local and international) regarding the use of
Web sites on the Internet.
TERMINATION. Without prejudice to any other rights,
PUPWebSite may terminate this TOU with you if you fail to comply with it. In such event, you must not
visit, browse, or interact with PUPWebSite again.
COPYRIGHT. All title, including but not limited to
copyrights, in and to PUPWebSite and any copies thereof are owned
by PUPWebSite. All title and intellectual property rights in and
to the content which may be accessed through use of PUPWebSite is
the property of the respective content owner and may be protected
by applicable copyright or other intellectual property laws and
treaties. This TOU grants you no rights to use such content. All
rights not expressly granted are reserved by PUPWebSite.
GOVERNMENT RESTRICTED RIGHTS. PUPWebSite is provided
with RESTRICTED RIGHTS. Use, duplication, or disclosure by the
Government is subject to restrictions as set forth in its
constitution, as applicable. Developer is PUP ICT Center, Polytechnic University of the Philippines, Manila, Philippines.
EXPORT RESTRICTIONS. You agree that you will not
export or re-export the copy of files of PUPWebSite to any
country, person, entity or end-user subject to international
export restrictions. You warrant and represent that neither
any bureau of export administration nor any other agency has
suspended, revoked or denied your export privileges.
NOTE ON INTERNET/WEB TECHNOLOGIES SUPPORT. PUPWebSite
may contain components written in Java®, JavaScript, Adobe®
Shockwave® (including Adobe® Flash), ActiveX®, Active Server
Pages™, .NET®, etc.
These technologies are not fault tolerant and is not
designed, manufactured, or intended for use or resale as on-line
control equipment in hazardous environments requiring fail-safe
performance, such as in the operation of nuclear facilities,
aircraft navigation or communication systems, air traffic control,
direct life support machines, or weapons systems, in which the
failure of these technologies could lead directly to death, personal
injury, or severe physical or environmental damage.
NO WARRANTIES. PUP and PUP ICT Center expressly disclaims any warranty,
if such exists, for PUPWebSite. PUPWEBSITE AND ANY RELATED
DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF
ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT
LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR
A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE ENTIRE RISK ARISING
OUT OF USE OR PERFORMANCE OF PUPWEBSITE REMAINS WITH YOU.
Every effort has been exerted to make PUPWebSite as complete,
accurate and updated as possible. The authors and the PUP ICT
Center shall have neither liability nor responsibility to any
person or entity with respect to any loss or damage arising from
the information contained in PUPWebSite. The information posted by
PUP ICT Center on PUPWebSite comes from several offices. Any query
or comment will be forwarded to the concerned offices for
appropriate action.
LIMITATION OF LIABILITY. To the maximum extent
permitted by applicable law, in no event shall PUP and PUP ICT
Center be liable for
any special, incidental, indirect, or consequential damages
whatsoever (including, without limitation, damages for loss of
business or personal profits, business or personal interruption, loss of business
or personal information, or any other pecuniary loss) arising out of the use
of or inability to use PUPWebSite.
RESERVATION OF RIGHTS. PUP and PUP ICT Center reserves
all rights not expressly indicated in this TOU.
MISCELLANEOUS. This TOU is governed by the
laws stated in International Treaties. Any violation made
against this TOU is punishable to the maximum extent possible
under the international laws and treaties.
